Terms and Conditions – Mozartkugel Workshop

(valid from 2025, legally compliant under Austrian law)

1. Scope

These General Terms and Conditions (GTC) apply to all contracts between Cornelia Straub – Unterricht für gastronomische Erzeugnisse (Mozart Chocolate), Werkstättenstraße 22, 5020 Salzburg-Itzling, Austria (hereinafter referred to as the ‘Organiser’) and customers or participants (hereinafter referred to as ‘Participants’) regarding participation in the Mozartkugel workshop.
This is a teaching activity in accordance with § 4 (1) Z 2 GewO (Austrian Trade Regulation Act), not commercial food production.

2. Subject matter of the contract

The subject matter of the contract is a practical workshop on making Mozartkugeln (‘Mozart Chocolate Workshop’).
The event serves to impart knowledge, experience and creativity.
The products made are not commercial food products, but part of the teaching.

3. Workshop services

    • Provision of all ingredients, materials, tools and packaging
    • Guidance from the organiser
    • Recipe sent by email after the workshop
    • Implementation at the location Werkstättenstraße 22, 5020 Salzburg
  • Additional services on request:
    • Private groups, company workshops
    • children’s birthday parties
    • Mobile implementation for 20 or more people

4. Booking & conclusion of contract

  1. Bookings are made
    1. directly from the organiser or
    2. via external platforms (e.g. GetYourGuide, TripAdvisor, Jochen Schweizer, mydays, Salzburg Info).
  2. When booking via platforms, their terms and conditions and payment conditions also apply.
  3. The contract shall only come into effect upon written confirmation of booking.

5. Terms of payment

Individuals

  • Payment is made in full in advance via the respective booking platform.

Group bookings (6 persons or more, valid from 2026)

  • Upon confirmation of booking, a deposit of €140 (equivalent to 4 participants) or 30% of the total amount, whichever is higher, is due.
  • The remaining amount must be paid no later than 14 days before the workshop begins.
  • Payment by bank transfer or payment link possible.
  • An appointment option can be held for a maximum of 30 days. If the deposit is not paid on time, the reservation will automatically expire.

6. Cancellation policy

Individuals

  • Cancellation up to 24 hours before the workshop: 100% refund
  • Less than 24 hours or no-show: no refund
Group bookings (6 persons or more, valid from 2026)
  • Cancellation up to 24 hours before the workshop: 100% refund
  • Less than 24 hours or no-show: no refund

Any advance payments already made will be offset against the cancellation costs.

A one-time rebooking is possible free of charge, provided that dates are available.

7. Terms and conditions of participation & children

  • Active participation possible from age 5 onwards
  • Children under 16 years of age must be accompanied by an adult.
  • Parents/guardians are liable for minors.
  • Participation is at your own risk.

8. Allergies, health & liability

  • Ingredients used may contain nuts.
  • People with nut allergies cannot participate, or can only do so at their own risk.
  • The organiser accepts no liability for allergic reactions unless these have been reported in writing in advance.
  • Participation is at your own risk; liability only applies in cases of intent or gross negligence.
  • No liability for clothing, valuables or personal belongings.

9. Use of photos and media

  • Photographs or videos will only be taken with the express consent of the participants.
  • Publication (website, social media, etc.) will only take place after voluntary GDPR consent has been given.

10. Right of withdrawal (only for online bookings)

For consumers, the Austrian Distance and Off-Premises Sales Act (FAGG) applies to online or telephone bookings:

  • Cancellation period: 14 days from conclusion of contract
  • No right of withdrawal if the workshop has already taken place or the customer has expressly agreed that the workshop will begin within the withdrawal period.
    A model withdrawal form will be provided upon request.

11. Data protection (GDPR)

  • Personal data will be used exclusively for contract processing.
  • No disclosure to third parties, except for payment and booking processing (e.g. platforms)

12. Choice of law & place of jurisdiction

  • Austrian law applies, with the exception of the UN Convention on Contracts for the International Sale of Goods.
  • Place of jurisdiction: Salzburg, where permissible
  • For consumers, the legal place of jurisdiction is their place of residence.

13. Severability clause

Should any provision of these General Terms and Conditions be invalid, the remaining provisions shall remain valid. The invalid provision shall be replaced by the statutory provision.
